About these terms

These Terms and Conditions govern your use of this website and the general information we publish about Apex Group and our products. They do not replace the policy wording, product terms, schedules or broker agreements that govern any actual insurance cover.

Who we are

Apex Group is an authorised financial services provider in South Africa, FSP No. 54988. References to "we", "us" and "our" mean Apex Group.

Acceptance of these terms

By accessing or using this website, you agree to these terms. If you do not agree with them, please do not use the site.

The broker channel

We distribute our products through independent brokers who are licensed financial services providers or representatives under FAIS. We do not provide financial advice to the public, and we do not deal directly with clients in place of their broker.

Your broker is your intermediary of record and is responsible for the advice given to you. Any information we provide to a client is given in support of that broker relationship.

General information, not advice

The content on this website is general information about our business and the insurance solutions we make available. It is not financial, legal, tax or insurance advice, and it does not take your personal circumstances, needs or objectives into account.

Before you act on anything on this site, speak to your broker or another appropriately licensed adviser.

Product descriptions, quotes and cover

• Product descriptions on this site are summaries only. Cover is governed by the policy wording, schedule, exclusions, conditions, excesses and limits that apply to the specific policy issued.
• Indicative terms, quotes and underwriting indications are not binding offers of cover. Cover only exists once underwriting has been accepted, the policy has been issued and the premium has been paid, or as expressly agreed in writing.
• We may decline, amend, restrict or cancel a risk in accordance with underwriting principles, the policy terms and applicable law.
• Premium, cover and terms may change at renewal, and we will communicate any change as required.

Claims

Claims must be reported to your broker or to us promptly, and in any event within the timeframes set out in the policy wording. Every claim is assessed against the terms of the policy, and no statement on this website creates an entitlement to cover or payment.

Intellectual property

All content on this website, including text, graphics, logos, imagery, layout and the Apex Group name and marks, belongs to us or is used with permission. You may view and print pages for your own lawful use, but you may not copy, reproduce, adapt, distribute, scrape or commercially exploit any part of the site without our prior written consent.

Acceptable use

• Do not use this website for any unlawful purpose or in breach of these terms.
• Do not attempt to gain unauthorised access to the site, its servers, or any connected system or data.
• Do not introduce viruses, malicious code, or any material designed to disrupt or damage the site.
• Do not harvest, extract or automate the collection of data from the site, or interfere with its normal operation.

Third-party links and content

This website may link to third-party sites or include third-party content for convenience. We do not control those sites and are not responsible for their content, accuracy, security or privacy practices.

Accuracy and availability

We work to keep the information on this site accurate and current, but we do not warrant that it is complete, accurate or up to date at all times, and information may change without notice. The site is provided on an "as is" basis, and we do not guarantee that it will be available uninterrupted or free of errors.

Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss arising from your use of, or inability to use, this website or reliance on its content.

Nothing in these terms limits any liability that cannot lawfully be limited, or any right you may have under the Consumer Protection Act 68 of 2008, FAIS or any other applicable legislation.

Indemnity

You indemnify Apex Group against any claim, loss, liability or expense arising from your breach of these terms or your unlawful or unauthorised use of this website.

Privacy and your personal information

We process personal information in accordance with POPIA. Our Privacy Policy explains what we collect, why we process it, who we share it with and how you can exercise your rights.

Electronic communications

You agree to receive communications from us electronically, including by email. Data messages sent to you comply with the requirements of the Electronic Communications and Transactions Act 25 of 2002 and are valid communications for legal purposes.

Conflict of interest

We maintain and apply a conflict of interest management policy as required by FAIS. Where a conflict of interest may arise in relation to a product, incentive or relationship, we identify and manage it, and we disclose it to affected parties as required.

Complaints

If you are unhappy with our service, please email hello@apexgroup.co.za with the details so that we can investigate and respond. We acknowledge complaints promptly and work to resolve them fairly.

If a complaint is not resolved to your satisfaction within six weeks, you may refer it to the FAIS Ombud, an independent and free dispute resolution service, at info@faisombud.co.za or through faisombud.co.za. You may also raise a matter with the Financial Sector Conduct Authority.

Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.

Changes to these terms

We may update these terms from time to time. The version published on this page applies from the date it is posted, and continued use of the site after that date constitutes acceptance of the updated terms.
